By accessing or using the Jobalign website (jobalign.com) or any related services (collectively, the "Service"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, please do not use the Service.

Jobalign is operated by Sails Software, Inc. ("we," "us," or "our"). We reserve the right to update these Terms at any time. Continued use of the Service after changes are posted constitutes your acceptance of the revised Terms.

Jobalign is an applicant tracking system (ATS) designed for high-volume, frontline hiring across industries including quick-service restaurants, senior living, hospitality, warehouses, and retail. The Service includes our website, marketing pages, demo request forms, and any related software or features we make available.

You must be at least 18 years of age and have the legal authority to enter into binding contracts on behalf of yourself or your employer to use the Service. By using the Service, you represent and warrant that you meet these requirements.

You agree to use the Service only for lawful purposes and in accordance with these Terms. You must not:

• Use the Service in any way that violates applicable federal, state, local, or international laws or regulations.
• Transmit any advertising, promotional material, spam, or any other form of unsolicited communication.
• Impersonate or attempt to impersonate Jobalign, an Jobalign employee, another user, or any other person or entity.
• Engage in any conduct that restricts or inhibits anyone's use or enjoyment of the Service.
• Attempt to gain unauthorised access to any portion of the Service, other accounts, or computer systems.
• Use any robot, spider, scraper, or other automated means to access the Service without our express written consent.

All content on the Service—including text, graphics, logos, images, and software—is the property of Efficient Hire, Inc. or its content suppliers and is protected by applicable intellectual property laws. You may not reproduce, distribute, modify, or create derivative works without our prior written permission.

The Jobalign name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of Sails Software, Inc. or its affiliates. You must not use these marks without our prior written permission.

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, error-free, or free of viruses or other harmful components.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL SAILS SOFTWARE, INC., ITS AFFILIATES, LICENSORS, SERVICE PROVIDERS, EMPLOYEES, AGENTS, OFFICERS, OR DIRECTORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.

OUR TOTAL CUMULATIVE LIABILITY TO YOU FOR ANY CLAIMS ARISING UNDER THESE TERMS SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM OR (B) ONE HUNDRED US DOLLARS ($100).

The Service may contain links to third-party websites or services that are not owned or controlled by us. We have no control over and assume no responsibility for the content, privacy policies, or practices of any third-party sites. We encourage you to review the terms and privacy policies of any third-party sites you visit.

These Terms are governed by and construed in accordance with the laws of the State of Michigan, without regard to its conflict of law principles. Any dispute arising from or relating to these Terms or the Service shall be resolved exclusively in the state or federal courts located in Novi, Michigan, and you consent to the personal jurisdiction of those courts.

We reserve the right to suspend or terminate your access to the Service at any time, with or without cause or notice, in our sole discretion. All provisions of these Terms that by their nature should survive termination will survive, including ownership provisions, warranty disclaimers, and limitations of liability.
